Is there a reason Death didn’t inherent Apocalypse throne ?

I’m reading Heir to Apocalypse issue 3 but maybe I missed it in the first two issues , he talks about how his actual 4 original horseman are gone in the hall showing them but Death is alive on Arrako right now ? Why not go have him inherit the throne and he was the most capable Horseman
