Buying marketplace games on a US console in Australia

I live in Australia and my friend gave me his US Xbox 360 and it’s region is still set to the US, and works with US/region free games. When I browse the marketplace it shows me the US listings for games (I can tell based off price diff).
If I buy a game, that is not listed as region free for the physical version, will it download & work ok even though my IP address is obviously in Australia? I could also use a VPN. and I imagine I’ll have to buy a us Xbox live voucher to pay?
