In the Democratic Republic of the Congo, old and contradictory laws stipulate land ownership and indicate that most land is held by the state and that the state can do whatever it wants with the land. This is an issue for the people of the Congo and therefore it is a priority of the government of the Congo to face the reforms that all governments before it hesitated about and avoided.
The state will be reviewing all legislation regarding land ownership and proposing a new bill in which all pre-constitution legislation is either enshrined or voided, offering a clear and non-contradictory law which serves to resolve disputes. Additionally, the government will be ensuring gender equality in these laws to make land ownership by women equal to land ownership by men. The state will also be appointing a Minister of Agriculture and opening a new ministry. It shall receive a budget starting the next fiscal year.
On the matter of land reforms, the government is going to assess state and private land ownership to nationalise and redivide large numbers of arable plots of land. Land will only be taken from the state and Congolese nationals as existing land leases to foreigners are economically important. However, the government will be scrutinising agricultural land leases to foreigners more heavily starting now as well as make it more difficult for the government to screw over its own citizens:
Land owned by the government of which the purpose is agriculture which in practise belongs to local farmers who have lived near and actively cultivated the land for more than five years or inherited the practise from family who have met those conditions will be given no more than five hectares of land for free.
Land owned by the private sector in Congolese hands of which the purpose is agriculture which in practise is not utilised for agriculture or which is situated around communities cut off from arable land will be nationalised by the government and divided among communities surrounding the land and no more than five hectares of land will be given to families at no cost.
On the matter of advancing agriculture beyond subsistence farming, the Ministry of Agriculture will be creating a subsidised investment fund which can provide Congolese farmers with microfinancing: low interest small-scale loans for farmers to purchase new technology or invest in their practise and low risk investment opportunities with the added benefit of doing something good for someone else.
The Ministry of Agriculture also wishes to set up mobile education units which can move around the country to educate farmers. For this the Congo hopes to cooperate with experts from the Midwest, Texas and India. The units will provide information about agricultural practises and technology, and should also be able to provide literacy courses to spouses of farmers and general economic education which can help a farmer maximise their profits.
