Does Woolworths seriously have a case to answer? RE: Misleading customers

Assuming we all know I'm talking about current legal proceedings against the supermarket giants and the "specials"/'deals' they promote.

As far as I am concerned Woolworths (dunno about Coles so much) should argue their case. I do not believe they are 'misleading' anyone as people detect the marketing ploys and go to lengths to demonstrate how savvy they are with many comments declaring the same awareness/behavior.
The tickets may not be the most lets say 'honest' way to pitch a product but it is just a method of marketing...the ticketing states all the key numbers in black and white...

Customers won't accept that they are getting a good deal on something even if it costs $5 when it should cost $6..why, because last week it was $4.50! They aren't misled, they are upset that the price has gone up, not at all grateful that it didn't go up even higher.

Additionally, if a customer asks a staff member to clarify the situation trained staff are capable of doing so. There is no ruse. There is no illusion. It is what it is.

As for the 'class action' - I don't know how these things work but if you put your name to it aren't you basically testifying to the Courts that you were personally misled? Is everyone that is signing that seriously going to be able to prove that if/where they have to?

Isn't an admission that you were misled a proclamation of how silly you truly are? It's not even a matter of being gullible because Woolworths aren't even trying to deceive people. If they were the best they could really hope to achieve is to fool certain customers for a very short period of time until the prices just became "the new normal".

Finally, for me, I feel all of this is noise and I'm surprised I did not get any whiff of news about the generic milk prices dropping at both companies. I know it's not generally the done thing but I'm in Woolworths corner on this one. If you're going to have a crack at the big guys at least make it over a legitimate problem/concern. This seems cheap and sleazy, against me being brutally honest. Reading the news article gave me the irrits :P
