I think the main asshole move would be breaking in to seize the squirrel in the first place which is a dumb waste of taxpayer funds, but furthermore, the guy had Peanut for seven years . This was not some wild animal off the street. This was a longtime pet that he raised from infancy.
Rabies is serious, but the circumstances of this point to NY state officials being total assholes in this case.
Why couldn't they just put him under 10 day observation like they do with suspected rabid dogs?

Depending on the bite location, it can take months to reach the brain and become fatal.
10 day observation period is standard procedure for dogs, cats and ferrets, as animals only shed the virus for a few days prior to them becoming symptomatic. If the animal is not symptomatic after that period, they are not rabid/contagious.
It begs the question of why does this standard apply to dogs, cats and ferrets but not squirrels and racoons? Presumably the state just does not care about wild animals nearly as much as pets, so they do not get the option to live in this case.
