I live in Oregon. But was wondering if the grey area about payroll/overtime calculations would apply similarly to any state that requires employers to pay a higher rate after 40 hours in a give work week,/pay period.
My timesheet was missing hours. Trying to get ahead of a discrepancy I brought it to the attention of my managers prior to checks being cut. I was told that nothing was missing yet because I hadn't yet even received my check to be upset about it. I said yes, but that I was just trying to be proactive about preventing what looked inevitable..
This was the first check in 3 months where I had actually accrued 10 hours of overtime, and I was apprehensive about the now missing hours I saw edited in my timesheet not being reflected appropriately at an overtime rate.
Low and behold as soon as checks were cut.. No overtime whatsoever. Out of 50 total hours to 45 were paid but still no time and a half rate.
On this same payday. I got called into a meeting at my office and was demoted. Though they did have the kindness to have sealed envelope ready with what was stated as the missing hours, and your welcome.
The off cycle paper had no amount of hours or any pay rate like in the byline of my normal checks. It as well didn't list the pay period, deductions, or rates of applicable taxes. The header stated Retro and the amount listed was $60.-5.60 for an unlisted reason totaling a take homel of 54.40. I normally make 20 and hour. This would only cover 3 hours at reg rate not 5 at an ot?!?!.
Is anybody on here familiar with payroll laws that I could run the actual numbers by. I'm trying to file a wage complaint but I get a little lost in the math of it.
