I am a homeowner that recently started renting out a spare room, which is where I think this gets tricky. New tenant was referred by my sister, moved in last month and has been a dream; super clean, quiet, paid rent on time. The kitchen and laundry room are pretty much the only shared spaces we have until I finish my addition to the basement. Then this happens and I'm not so sure how things will move forward.
I was baking some edibles last night for a friend, and once they were all out of the oven I left them on cooling racks while taking one to the basement for myself. I had planned to come back up before going to bed to wrap up the rest of the cookies, but hadn't finished baking till after 9 and was working pretty much up till that point, so I passed out.
I don't eat breakfast, and my schedule worked out that it would be easiest to wrap up the cookies and deliver them when I came home for lunch today. This is all to say I hadn't put the cookies away since I left them out around 9:30pm. I get home just after noon today and see another cookie had been taken from the baking sheet. I also notice that the tenants car is home when he's normally working right now, which lead me to believe he didn't realize they were weed cookies when he ate one, then had to come home from work to sleep it off once he realized. This kid does not partake as far as I'm aware.
Am I at all liable here? I would like to think that it's a clear case because he didn't ask before taking a cookie, but I was laughing about it with some friends and they brought up the possibility of negligence in a shared space. Am I supposed to put up a sign that says "Please Don't Eat(but if you do, be careful. There is 50mg of THC in each of these)"?
