What counts as architecture/protected IP?

I get that anything recognizable would need a release, cars and urban buildings are easy, but when are buildings and structures in the background recognizable?

Iā€™m mainly torn on some pics I took at a playground. I figure the whole thing is easily recognizable as some brand or other (not in the play structure industry) but at what point do you guys think it becomes a non-issue?

And what about houses, especially in the background of the aforementioned playground? Like is it the owner or the builder/brand or is it generally a non-issue?
