I'm in the process of setting up a business structure to initially to start flipping land and at a later stage buy property to rent out. I want t sort out family assets at the same time, so looking at a irrevocable trust. I found some amazing YouTube clips by a legal firm for exactly what I want to do, but some of the lawyers I spoke to seem to give me pre-canned answers. So, before I commit to a legal firm (and I will speak to someone, this is jus to get input from others that are experienced so I don't waste time back and forth with a lawyer), I wanted to get your thoughts on this structure https://imgur.com/RaGuztc that I created after watching these 2 excellent clips from a legal expert - https://youtu.be/ZVKSw16Tttk and https://youtu.be/GJyIb6-SMNI. For planning purposes, I'm just assuming land flipping and rental properties will only by in NC and FL for now, but it expands out every time I move into a new state. The other option I found on a RE Investment legal website was this one. It seems excessive and I would likely not opt for the Series LLC with it not being recognized in many states, but thought I would share - https://imgur.com/anw8djZ
I'm really aiming to achieve 3 main goals with a subset of goals -
- Setup a trust to ensure my family is looked after and my personal assets are protected (Phase 1)
- Setup a land flipping business & Invest in Tax Liens (Phase 1)
- Primary focus: Tax Efficiency and Easy of use
- Secondary focus: Anonymity and Charging Order protection
- Setup a rental property business (Phase 2)
- Primary Focus: Anonymity and Charging Order protection due to increased risk of litigation and higher valued assets
- Secondary Focus: Tax Efficiency and Easy of use
Any thoughts or input would be greatly appreciated. As I said, I will consult a lawyer before moving forward, but the clearer I am on what I want to achieve, the easier and more fruitful the conversation will be with the lawyer.
