Hello there and thanks for reading this! I'm under contract to buy a fourplex (in Missouri if it makes a difference). It's in good shape and the seller was even willing to fix things that were found deficient during the inspection. The ROI is decent also and it's in a good neighborhood.
The problem is that one of the tenants who moved in yesterday has two cats, claiming they're emotional support animals. This tenant did not mention the cats beforehand and I do not want pets in my building since they wreak havoc on homes. This tenant already was iffy to me because she had a 550 credit score, but the seller said there were extenuating circumstances and the realtor had a similar tenant situation in the past that ended up being a good tenant.
What recourse do I have? I'm thinking if I live in one of the units, it would be owner occupied and therefore not subject to the requirements for emotional support animals, but this tenant has a signed lease so I'm not sure. I am following up with lawyers, but I figured more insight into my situation would be better than less. I could also cancel the contract to purchase, though I'd likely be out $5k. I just don't trust this new tenant since they hid this and feel like the seller should have anticipated some nonsense happening given the low credit score. It's my fault in part for believing the seller and my realtor, but my realtor has been very informative throughout this whole process so I haven't had reason to doubt her.
