(This happened in Colorado) So this guy I know is going through a very difficult patch in his life. This is obvious because he's on pretrial currently for felony charge., he got into a car accident the other day, his fault, hurt the other driver, was intoxicated, then drove to a friend's house and threw a rock through their window. Police were at the scene of the car accident and then they were called to the friend's house for the disturbance. He was ticketed for criminal mischief or something like that. No arrests have been made even though he very obviously has violated a pre-trial agreement.
I let him stay with me a few days ago but he is too much trouble and I told him he can no longer stay with me. Yesterday he got all these things and I dropped him off at someone else's house and I thought that was that. Today he text me that he is walking to my house to kick my ass. I thought this was a joke but he showed up at my door, covered my peephole, and was yelling he was going to beat my ass. And I wouldn't open the door for him and after I told him to leave and that I will be calling the police he then threatened to damage my car which was parked close. I walk out of my door to see him folding the passenger side mirror back. That's when he jumped at me I tried to run inside and shut the door but he made his way inside. He grabbed me and put me in a headlock and punch me in the head a few times. Luckily I managed to dial 911 and was holding my phone with the dispatcher listening to us the whole time. Once you realize that he was being recorded and the police were probably on their way he ran out the door. After police showed up and took my statement, I chose to leave and go to a friend's house because I did not want to be by myself at home anymore. Leaving my neighborhood I saw the police officers speaking to this guy. In the time it took me to drive to my friend's house, realize she wasn't there and then drive home, the police were still talking to the guy maybe 50 yards away from my home. I just got a call from the officer and they said that the ticketed him for 3rd degree assault and that if he comes by again to give them a call. My question is why hasn't this man been arrested? My friend thought he should have been arrested when he threw a giant rock through her window last week. I was hoping he would be arrested today because there's not much stopping him from attempting it again. Is third degree assault an arrestable offense in Colorado and if it is why wasn't he arrested?
