Swapping perk builds bug?

I just decided to check out the new build swapping feature and created a new build in the free slot. It gave me 110 skill points, which is what you get for max level without infamy (I think). I put all my available points into it and was able to select the build despite only being level 92, and not level 100.
I haven't been able to test if you get the skills in a heist. Anyone noticed this?
In case none of that made sense: only level 92, yet able to use build that would require level 100.
