Hit by uninsured driver but they DO have house insurance. Can I/should I sue?

Post Body

I was rear ended by an uninsured driver. Bad accident, witnesses, police report etc. They hit me while I was fully stopped at a red light going 50, never tapped the brakes. I’m injured and the car is very likely totaled. I’ve only had the car 3 weeks. They said they had insurance and gave a policy number to the police and I. When I called, it’s a home insurance policy, not a car policy. The car policy lapsed years ago. They were driving a shit box and young (insurance thinks the policy is under their parent(s) and that’s who the car shows as owner) but since I know they have a home owners policy and likely own a home, would it be worth it to sue them?

I can’t use my insurance for any property damage but I am using my insurance for medical and uninsured bodily harm. I was a fuggin idiot when I grabbed insurance, I’m aware. It was my first time doing it without a bank lein/loan so I totally fucked up.

Any advice is appreciated but I’m at my wits end so plz hold the mean shit, I’m literally sewersidal over it all.
