We wanted to share out some quick things you should know about what's changing in Landlord Tenant Law in 2024 here in Oregon! As a disclaimer, SETA does not and cannot give legal advice. Changes to ORS 90.295
Application Fee Transparency:
Landlords must now send Applicants confirmations and receipts from any company/agency used during screening
Application Fee Refunds:
Landlords must now refund application fees within 30 days if they fill the vacant dwelling before screening an applicant or if they have not completed the screening of the applicant and the applicant withdraws the application in writing
Increased Protections:
Gender Identity has been added to the list of protected classes in the screening/application process
Changes to ORS 90.155
Electronic Notices can be sent if the landlord and tenant sign an addendum to the rental agreement after the tenant has moved in. Both the tenant and the landlord need to specify which email addresses they will each use to send and receive emails
ORS 90.385 ORS 90.385
Landlords may not prohibit dwellings from being used as childcare home under certain circumstances and cannot retaliate against a tenant attempting to use the dwelling as a child care home
