Question for mechanic folks - Should this have passed a safety cert?

My brother bought a 2008 Rav4 with a safety cert a few months ago. The last couple weeks it started riding rough so he took it to a mechanic.
The mechanic found that the front passenger bearings are failing and that there's a power steering leak (was almost empty).
Should either of these things been flagged when the safety inspection was done?
