When I began my ENM journey as a married person myself, I noticed in my area there were a large amount of married active duty service members who were also pursuing ENM lifestyles. Which is fine except it is *TECHNICALLY* in violation of the UCMJ article 134.

I remember hearing about a case (like 13 years ago) when a Master Chief (m) had a consensual threesome with his wife and one other woman and they filmed it for personal use. This video was later leaked and his command got wind of it. He was forced into retirement and reduced in rank. Why was this a big deal? It wasn't... except his uniform was hanging over the chair in the background with his full name and service visible.

I did some digging and the verbiage has been updated since 2019, so if we have any service members out there or people seeing someone in the service, here is some advice from a non-legal person who has done their research.

The following info applies to married service members, but if you're not married, still heed warning.

1. If you are a service member and have an online dating profile DO NOT list what branch of service you are in or post pics of you in uniform if you state your paired/married and open. Simply list MILITARY as your job if you must. There is nothing in the UCMJ that states you cannot have a dating profile.
2. This should be self-explanatory, but DO NOT date anyone at your unit and for the love of God avoid anyone in your chain of command or enlisted/officer relationships. If you are stationed afloat on anything from a 65ft vessel all the way up to an aircraft carrier usually you are not allowed to bump nasties with anyone who serves on the same vessel, whether the sex occurs on or off land. This is the MOST likely way to get in trouble for multiple reasons on top of Article 134.
3. Do not do anything that discredits your service. This can include a sex tape as mentioned earlier, all the way down to a sexy selfie sent while you're changing out of your uniform. Don't risk it.
4. If for some reason your command finds your dating profile and sits you down, make sure your spouse would be willing to tell your command your ENM if it comes down to it. Normally if the above standards are not an issue, they just don't want to have an angry spouse calling the XO because they found a used condom in your car. Commands hate drama and if there isn't any they will likely leave you alone.
