Hi All,

I've recently appealed a Wilson's parking ticket, using the method here - https://www.reddit.com/r/newzealand/comments/77bz67/how_to_defend_a_65_wilsons_parking_ticket/

However, they have recently responded (likely due to the number of disputes I have with them) the following email.

Does anyone have a standardized response I can send to them based on the below?

The only info I've removed is my personal info.

Re: Parking Breach Notice xxx Registration xxx

Thank you for your recent communication regarding the above Breach Notice.

We have not terminated correspondence to previous dispute. Appeal response was sent via email on - xxx

As previously explained, when parkers use this car park they are entering into a contract with the car park operator. The terms of the contract are set out on the Important Notice to People Entering this Carpark with a Vehicle signage and on the internal car park signage. These signs are displayed prominently at this car park.

The breach notice fee, which is also clearly displayed in this carpark, is a contractual term of the contract and can be enforced by the car park operator as its terms of contract. The breach notice fee is the cost of enforcing the car park's terms and conditions of parking. This fee is payable under the contract and is not a penalty, a fine or a claim for liquidated damages.

Parking Enforcement Services retrieves payment relating to its breach notices issued at sites across New Zealand in accordance with accepted principles of contract law. This has been tested and upheld by the Disputes Tribunal when this practice has been challenged.

We decline your offer of $3.00, as full and final settlement. We do not accept payments for parking as this is made to Wilson Parking and not to Parking Enforcement Services.

We can confirm that it was issued in accordance with our procedures and the Terms and Conditions of parking which are displayed on the Important Notice and signage at this car park, therefore, the Breach Notice will stand.

The breach notice unfortunately cannot be waived as it was issued in accordance with a breach of Terms and Conditions of the car park. We are unable to enter into any further correspondence in regards to the breach notice.
