This verdict will be inclusive of the valid evidence, mindful of the insightful comment by ProgrammerDan found here (https://www.reddit.com/r/mtaugustajustice/comments/3msjfe/requesting_trial/cvt0nws), and above all, fair.

Bluesylvaer stands accused of aiding and abetting a group herein referred to as “TBCrew”. As such, he is being prosecuted for TBCrew’s crimes under the material assistance clauses. Since it would put an unfair burden on the prosecution and the defendant (and the judges, for that matter), the prosecution was not required to list and prove each individual case pertaining to TBCrew. Simply proving that the defendant materially assisted TBCrew, the criminal group, caused this trial to last four times the normal time of three days, and this verdict is coming out two weeks after the trial started. So, in order to keep the trial timely and to keep the trial fair for both the defendant and the prosecution, the prosecution was not required to prove each instance of criminal activity of each helped member of TBCrew, and was only required to prove that Bluesylvaer materially assisted TBCrew.

The prosecution, led by one of the purported victims of TBCrew, JFCamp, used several pieces of evidence in trying to show that Bluesylvaer materially assisted TBCrew. JF used skype screenshots and the help of several others to prove his point that Bluesylvaer materially assisted TBCrew.

The defense, led by Bluesylvaer himself, attempted to put the screenshot evidence into context.

Who won the case? This is a difficult question.

Before attempting to answer it, I attempted to gather the facts of the case.

1. The screenshots provided are not valid evidence because one party did not agree that the evidence was real. If the prosecution uses screenshots of chat logs that are out of game, not including reddit logs, then the defendant must confirm that the screenshots are real in order for them to be included as legitimate evidence in a verdict and vice versa.

2. Bluesylvaer was unable to play Minecraft for the duration of the events of the case.

3. Bluesylvaer had added several members of TBCrew to relevant groups in Hjaltland prior to his leave of absence.

4. Bluesylvaer took these members off the most sensitive groups before he left.

5. Bluesylvaer mentioned on reddit on several occasions that he intended to take TBCrew members off all Hjaltland groups as soon as possible.

Note that numbers 2-5 come from what Bluesylvaer said on reddit, not from what he said on another service.

Using these five facts, it is obvious to this justice that Bluesylvaer’s supposed material assistance resulted from nothing more than unavoidable inaction on the part of the defendant. Bluesylvaer added these people because he believed in their overall mission, not in their specific acts. Therefore, Bluesylvaer did not add them to the groups for the explicit purpose of committing the several crimes of which members of TBCrew are accused. He added them because he believed in the general purpose of the group. If Bluesylvaer had been able to take them off of the groups and did not take them off of those groups, then he would have assisted TBCrew materially, but not to commit specific crimes. As it was in this case, Bluesylvaer was unable but willing to take TBCrew members off the groups, which make him not guilty of the accusations which he currently faces. Bluesylvaer is innocent because even though he materially assisted TBCrew, he did not do so in order to help TBCrew commit specific crimes.

Additionally, the prosecution never proved beyond a reasonable doubt that Bluesylvaer committed the crimes of which he was accused. I am using this standard of evidence because Bluesylvaer was accused of helping with dozens of purported crimes. Maybe these charges by themselves do not require the prosecution to prove guilt beyond a reasonable doubt, but taken together, they most definitely do. Now I will explain section-by-section why JFCamp and the prosecution failed to prove beyond a reasonable doubt that Bluesylvaer was guilty.

A. This doubt is based in reason. The support Bluesylvaer granted was not in relation to specific crimes.

B. This reasonable doubt takes into account the evidence. The validity of the evidence was not clear throughout the case, and that is enough to plant a reasonable doubt in my mind that Bluesylvaer did not commit the crimes of which he is being accused.

C. This doubt is not based on guesswork. From the issues with the accusations, to the issues with the evidence, there are many holes in the reasoning of the prosecution.

D. This verdict is not based on sympathy or fear. The prosecution tried to have me taken off the case for my relation to Bluesylvaer. Vicccy and I decided that I should stay on the case. What sympathy I have for Bluesylvaer did not come into account in this case, and neither did my considerable fear of TBCrew’s enemies, who are certainly interested in the outcome of this case.

E. I am not attempting to escape the responsibility of a decision. I am using the evidence and the arguments that I have been given to make a logical conclusion.

Now, it is time to take into account the failings of the prosecution on another level. Several times the prosecution and its associates asked for extensions. I granted them, and the trial lasted for 12 days. Little new evidence was presented in that time, but much argumentation took place. In the future, I will try not to grant copious extensions for fear of having another trial like this. It is unfair to the defendant, who has a longer time to wait until a decision is made, and unfair to the judges. I would ask my fellow judges not to extend the time for a trial unless it is absolutely necessary.

Bluesylvaer is innocent because his intent was not to cause criminal acts against MTA and because the prosecution failed to prove his assistance directly supported criminal activity.
