Let's say someone agrees to an obviously illegal contract to commit a crime, accepts payment, and then refuses to deliver. The contract is invalid...but does he have to give back the money?

Tom is upset with someone and decides to hire an assassin, Bill, to kill him. He pays the assassin $5000, but after taking the money, Bill refuses to kill the target.

Legally, what happens now? It's an illegal contract, so the courts won't enforce it, right? But does the money count as stolen? Would bill have to give it back?
