Get Council to move a Lamppost

Post Body

Hi all

Hoping to get a guide before retaining a solicitor.

So, our house was built in 1985, and for some reason a lamppost was put in our garden right up against the path, bang in the middle of the property. We bought it about 10 years ago, and have recently looked into getting it moved as we want to double-up the driveway.

Contacted the council, and over the last few months they have said that they won’t move it. Then they said the land under it is theirs, so it’s nothing to do with us. Finally they have said we can pay to move it, it it will cost between 10-15k…seemingly as a “go away” price.

So, regarding the land on our property underneath the lamppost being the councils, could this be the case?

90% of the lampposts are on footpaths in our estate, with just a handful in gardens.

Do I have any legal standing to demand the removal of the lamppost?

Thanks
