I was hit by a car last night (I was pedestrian) crossing with a green light & the walk signal was lit.
*** Updated: I've received the information I was looking for. Thanks! :) ***
The vehicle that hit me was approaching a red light and making a right hand turn. He didn't even slow down for the red and wasn't looking at the oncoming cars, he was looking at something behind him to the right. He was doing at least 10-15/kmph
He came up so fast, that I, as I was crossing, didn't even see him and was directly in front of him before he hit me. Barely caught him as movement out of my peripheral vision.
I ALWAYS pay attention to cars approaching the light as I cross for exactly this reason. He was not there as I was crossing, so maybe he turned onto that street from one of the many parking lots, or he just came full speed down the street (speed limit 50km)
I was 3-5ft from the opposite curb, so right in the middle of the front of his SUV when he hit me.
I smashed my hand into the hood of his car as I stumbled backwards into the roadway and he continued his turn without even slowing. He didn't even look at me when I smashed his hood, clearly ignored or didn't hear the loud impact.
When I stumbled backwards, I smashed my fist into his driver's window trying to get his attention. He was still moving past me, and was so close that he was brushing against my coat and it was being pulled sideways with the car.
He looked right at me, then turned forward, finished his turn and fled.
I didn't need an ambulance, but am seeking medical attention this morning. Last night I clearly could feel my ankle had been rolled (which I reported to police), but I had been walking in the cold (-10) for half and hour and was in shock.
I filed a police report immediately and they did go directly to his house. They gave me the Cst. badge number so I can send any medical updates once I was able go sit down and actually see how my body felt.
I did call and update the case file last night to let them know that once I got home and settled, I could definitely feel pain all through the left side of my back in rib cage area and my left arm.
When he hit me, it caused me to lean forward on the hood of his SUV, then it rolled me off sideways to the right (drivers side) as he kept moving. So my whole body torqued/twisted back and left, which is when I rolled my ankle.
This morning I woke up with brutal pain in my neck on the left, limited range of motion, and a nasty headache, so I am going to my Dr/urgent care in a couple hours for xrays etc.
Police asked me last night "so what do you want to get out of this" (this is about 30 mins after the incident) I was a bit stunned and confused by the question, so I said I didn't call you for money if that's what you mean...I called you so you can charge him or ticket him at least or whatever you do to someone who doesn't even slow for a red light, never mind hitting a pedestrian and fleeing the scene when he knows it happened.
Nonetheless, I've realized that I now have to pay movers (I'm literally supposed to be moving to a new house today, already had to put that off to tomorrow, but I won't be able to do any more packing, let alone lifting or carrying/moving furniture).
Long story still long 🤣...
It looks like it's going to cost me $2500 for movers now (last minute emergency booking, month end, holiday weekend, packing as well) so how do I make him pay that?
Should I consider some kind of compensation for injury once I've seen a Dr.?
I've had lots of people tell me that I should not just say no immediately to financial compensation. Including someone who works in insurance.
Even though my default is to not be someone who wants to cause problems for others, this actually IS a big deal, and even though it wasn't a case of being rushed to the hospital in an ambulance bleeding, soft tissue injuries are often worse because they take longer to heal and can end up being lifelong issues.
I've also been told that when you file for financial compensation in a case like this, you also sue for emotional/mental stress/trauma?
The police can not give me his name/insurance info I would assume because of FOIP.
I can't afford a lawyer, and while I know about civil court (I still dont have his info to file) I've had several people tell me this is 100% an issue that should be filed against his insurance.
Apologies if this is a lot of rambling, I've never had an experience like this so my brain is all over the place right now.
I just know my whole body hurts, I'm panicked about this moving issue, and this guy didn't give a shit that he hit me (twice technically, front and side of vehicle). The last thing I need is lifelong muscle damage at 45 😞
So my questions are:
- I assume the police will press charges of some kind, am I entitled to know that? I am not the one who can have him charged correct? Ie the way you can with assault.
(Fleeing the scene, hitting a pedestrian, failing to stop for a red light, I imagine these are all tickets that can and should be issued? How do I press the police to make damn sure they charge him and it's not a case of just a slap on the wrist. This was serious and could have been a lot worse, he shouldn't get away with it.)
How do I obtain the drivers insurance/personal information needed to file a claim? Civil or otherwise.
How do I actually file against his insurance for the injury/damages (ie moving expenses)?
Should I be giving more consideration to compensation for injury? Given the extent that I can feel today and the fact that at my age (44) this kind of soft tissue damage could have long term effect that I won't really know/understand until some time has passed is it important to do?
If there's anything else important I'm missing, please fill me in. I've got no idea what I'm doing or how/what needs to be handled.
Thanks to anyone who can give any answers
