Breach of contract? Abandoned job?- Contractor Question

Hired a contractor to do a backyard renovation for us (concrete slab and retaining wall installation with dirt work- all written in contact). Work started in May. Slab poured in June. After the pour the slab was bad quality (bad concrete pour and bad stamp/stain work). Contractor agreed (verbally) in July to redo it and to get remaining dirt out of our yard. Since July, they have only been back twice (to collect dirt, the majority of which still remains). Right now we are left with a bad patio that has been agreed to be replaced, no retaining wall, and a mountain of dirt in our back yard. Also, everything was paid for upfront (my mistake).

While we never see anyone actually working, the contractor constantly communicates with us and tells us heโ€™s going to get it done. We are honestly to the point where we donโ€™t even want him to finish, and use someone else to complete the job.

What are our options? Can we get him for beach of contract? Paid over 30k for the job
