HIPAA Violation / Medical Malpractice?
Post Body

tl;dr (31M) my overbearing // controlling ā€œmotherā€ called my doctor and demanded that he no longer prescribe me the anti-anxiety medication that has been prescribed to me for the last 12 or so years. Doctor now refuses to fill my monthly script.

Hi all, Iā€™m a 31 yr. old guy and was in rehab for alcohol (i.e. NOT benzos) for a bit more than 2 months. FWIW Iā€™m temporarily back under my parentsā€™ roof, helping my old man recover from a few illnesses. During my stint in the Nevada rehab, my overbearing and controlling mother found my monthly prescription of legally-prescribed lorazepam. She then proceeded to call my doctorā€™s office to demand that he not prescribe it to me anymore since Iā€™d gone to rehab of my own volition. She happened to ā€œforgetā€ to also share the reason for my being there which was strictly for booze.

Iā€™ve never once given her permission to act on my behalf in a medical capacity (nor would I ever) but she went behind my back and did so anyway. Itā€™s probably also worth noting that she planted a tracking device in my car to keep tabs on me. Againā€¦Iā€™m 31.

I think that, legally, my doctor cannot make a clinical decision based solely off of my momā€™s demands, but he is doing exactly that. In fact he just called to say that he will no longer be prescribing me lorazepam ā€” a medication that has worked charms for my crippling anxiety over the past decade ā€” and have truly never abused (surprising, I know).

My dad tried to protect her and justify it by saying she did it ā€œout of care and concernā€ but Iā€™m sorry, thatā€™s a serious overstep and violation of my privacy (as was the tracking device in my Honda)

Any legal recourse here? Iā€™ve never granted her access to my records / treatment history and had only listed her as an emergency contact in the case that the doctorā€™s office needed to contact her - not the other way around. Oh yeah, she also picked up other Rxs of mine from the pharmacy ā€” again behind my back and without my permission.

Any advice (aside from telling me I need to move the fuck out) would be greatly appreciated. If you couldnā€™t already tell, Iā€™m lividā€¦

TIA
