I recently purchased a property that came with a home warranty. The home warranty was in place to cover major systems (that are a bit older) in the event of failure during the first year of ownership. A few days ago, a leak was noticed in the finished basement. Plumbing leaks were covered, so I called it in. They sent a contractor, who recommended a fix that involved cutting through wood to access the pipe. I paid the $100 service fee and awaited the decision. The claim was denied as accessing through wood was not covered by the warranty. I called another plumber and they were able to access the pipe from the laundry room (pipe ran above the wood covered area) and replace it in about 45 minutes. Total cost of about $300. Would I have any recourses to try and recoup any money since the home warranty’s contractor recommended work that was denied? If I were to attempt to sue them in small claims court, who would I sue? The local contractor or the home warranty company located in Denver? Or both? Just the work itself is covered, not replacing the damaged ceiling tiles (which is easy to replace). I have plenty of time to pursue this, so I’m just looking into which direction to take. I plan to call the warranty company to see what they say before taking any further legal steps. Any suggestions are greatly appreciated!
