Hope this has a simple answer.
In 2017 my now ex wife filed taxes for us and didn't include my income. She took the refund as we have 2 kids together. Push forward to 2021, I am cleaning up my taxes and am informed that for 2017 I didn't file anything. I sent all my income to my accountant and she amended the return. Now there is a substantial amount owed as I am self employed plus interest and penalties.
My ex is completely ignoring the fact we need to pay.
My question is can I take her to small claims court for half the amount and I'll just pay the taxes owed since either way they need to be paid and I'd rather not accrue any more interest. If I do take her to small claims court what are my odds of winning?
