Home modification missing

So our mortgage just sold to a new company about two months ago. We are looking into a refinance there is no documentation of our loan modification from a previous foreclosure. We spoke to the new company and they confirmed there is no modification or a second mortgage attached to our loan. Our loan officer said we could possibly be exempt from paying it since they have no knowledge of it. Is this true, especially since they said it on a recorded line. Loan officer is through emortgage funding llc
