How do I get my car back?
Post Body

I had made a deal with a prior boss of mine to purchase a car for $2400. I paid half upfront and $100 was taken out of my check every week until the rest was paid off...Shortly after I paid off the car while waiting for the title to be transferred, my vehicle was towed due to a break-in which occurred while i was out of town...I actually thought the car was stolen. I called around to see what had occurred but none of the tow truck companies had my car.

Lo and behold, they contacted my boss, whose name the car was still titled too, and she got it out of the impound lot and then kept the car. She claimed I owed her an additional $700...and would have to pay before getting the car back.

I thought this was ludicrous considering prior to the tow, the vehicle was already paid for and rightfully mine...I made it clear that I did not agree with her keeping my only car.

I certainly did not agree that she go get my car out of the tow yard. However, as she was my boss and I trusted her (I worked there for 2 years) I decided to just pay her and get it out of the way... It was tough to get a head losing $100-$200 every week so I told her I would be paying her back as quickly as possible so I could get my car and be done with the whole ordeal.

But, after paying her $400 while still employed, driving an old motorcycle to and from work in January, I am fired the week I planned to make the final payment for being 20 minutes late.

After some arguing, she suddenly claimed I owed her even more money for alleged 'repairs' and that she would have to sell the car to "cover her losses".

Can I take her to small claims and get my vehicle or at the very least, my money back?

Can I sue her for keeping my car from me and getting it out of the towyard behind my back?

tldr; I made payments for a car. paid off car. never got title. car was towed, title owner was contacted instead of me. she got the car and kept it from me demanding further payments. half way through making said payments, claims i owe an additional $1200 because of lot fees and 'repairs'. tells me she is going to sell the car to cover 'her losses'....do I have a case to get my car back damages in small claims?
