My mother entered some items in to auction that went through and got paid out, among the items was a gold ring that was not entered but remained at the auction house pending pick up. The auction house paid out the items that went through but made an error on the payout and included other items so it was more than it should have been, they realised the error and requested the amount in error to be returned. My mother refused to pay this as the invoice did indeed include extra lots that weren't hers but was also missing lots that where, the auction house is now however refusing to hand back the previously mentioned gold ring unless the overpayment is returned.
Where does she stand legally? The outstanding invoice caused by their own error would be a civil matter I believe however them refusing to release her property that was not part of the auction is possibly a criminal matter for police?
Any advice greatly appreciated.
