Former employer keeping my tip outs? (Oregon)

Post Body

Alright so I live in oregon and worked as a Busser for a restaurant and moved suddenly so I gave my employer less than 48 hours notice. Is it legal for them to keep my tip out because of that?

Hey so I received my check but It didn’t have any tip out included on it, any idea what happened?

Me^

Employer response: Matthew,

This would be due to the fact that the tip pool is processed bi weekly with payroll. Since you quit with short notice and we were required by law to cut a check and have it post marked by 5 business days unfortunately you were not included in the tip pool. If we were given more of a notice I’m sure we could of worked something out. Good luck on your current endeavors and I hope you the best. We appreciated you time and if you ever wish to return we would be more than welcome to bring you back.

Thank you,
