Last week winds cracked a large limb on one of our backyard trees causing it to hang down a bit. It did not sever completely so it is just hanging there, but could break at any minute. The limb hangs over an adjoining property as well. The adjoining property is an apartment building. The limb is hanging over the parking lot of this building a bit. I am worried that it could break and damage a car or even injure someone.
I've talked to the apartment building managers and they seem to view my calls as a 'hassle'. I've recommended that the affected parking spots be vacated until the tree can be cut down. The managers have said they will contact the vehicle owners that are parking there but the cars are still there. The managers seem to care only that it affects their tenants parking, and don't seem concerned about the potential danger. In additional they also won't give me a straight answer as to whether a tree company can use their parking lot in order to more easily access the tree. In short they are being dicks. I've called and written the property management company and no one is getting back to me.
We were perfectly fine with trying to get the whole tree taken down and covering the cost ourselves. However we just facebooked this problem to our network and some people are saying that limbs hanging over a neighbours property are actually the responsibility of the neighbour. Is this true? I want a) someone on their side to acknowledge they have heard my pleas of danger b) do all I can to tell them that I've warned them (so I am not liable) and c) not create an acrimonious neighbour situation if I can help it.
What should/can I do here? This is Ontario, Canada.
