Today a company come out and repossessed a storage shed left on my property. The shed belonged to a renter at the address previously and was abandoned at the address. Apparently there was a work order put in with this company to get this shed on June 4th 2020.
I put my offer in mid July, which included a clause that if the shed was not part of the property, it had to be removed and any damage to yard repaired. I closed in mid August and was told that they were not taking the shed and it was now mine as of closing. According to my realtor the owner of the property and his lawyer were in agreement on this.
However the shed was not owned by the owner of the property, and the renter did not own the shed either. The rental company, which had put in a request with a 3rd party to remove the shed almost 6 months ago owns the shed. The state is Kentucky, shed is valued over $1,000, I am curious what my options are and who is at fault? Police were called, they let them take the shed and there is police report or anything because there is nothing to indicate it was criminal and this would have to be a civil issue.
