Hello everyone! I have been trying to find out about the Employment Laws in the state of GA.
I'm a Manager for a small Ambulance company, and I am salaried. My pay is about 825.00 gross/weekly.
I'm asking this because I recently found out about a stipulation(for lack of a better word) in the law about being salaried. Namely, that it only covers an average of 60 hours a week.
Part of my job is answering the phones, and since GA requires ambulance companies to have the phones monitored 24/7 incase of a state-wide emergency, I have a company provided cell phone that I have to keep on me at all times to answer. This means that even if I am not answering the phone, working on the schedule, or taking patient information at every minute of the day, I am required to be ready to do so. The jargon used in EMS is being 'on call'.
It's not uncommon to get calls at 2 or 3 am, and even sometimes while I am trying to shower or eat dinner, I get calls.
I have mentioned this to a few people, who have all said that I should look into this, as I may have a case for back pay owed. Despite these conversations, and my searches, I can't find any specific laws that prove or disprove the points.
Am I owed compensation do I have a case, and what points of Law should I look at to prove or disprove this?
