Internet Service Provider issue

I live in the US, VA specifically. I'm looking at changing ISP because I'm sick of throttling and data cap's associated with Satellite Internet. However, no cable provider can come out, besides one, because this One has a contract on the area. The issue is, they're not willing to come out here, and they're not releasing the contract. I know it's not technically a monopoly since satellite ISP's can come out. This can't be lawful; to hold a contract and not utilize it, withholding the service associated with it from the residents in the area.
