NY Divorce question

So the situation is I currently have full custody of the children paroled to me via family court as a a result of an article 10 filing. I pulled my joint custody divorce and re-filed a no fault for full custody. CPS is charging her with multiple counts of child neglect. What are the chances that she can beat my divorce filing? Or at least how long can she drag it out in court?
