This is my first post on here but I felt this was a good place to come for a start on what to do. I work for a company that uses a third-party payroll service. I've been working for the company for a while and previously the company used a different, well-known payroll service and I never had any issues with pay or anything really. But recently, after a company merger, the new payroll service that the company switched to has been nothing but problems! I've had consistent issues with wrong pay rates, I've been shorted small amounts of hours, weird additions and subtractions on check stubs that make it indecipherable, among a few other small things. One thing that sticks out in my mind is the fact that I was overpaid on one of my paychecks (third time since using this new payroll system) and of course the company wanted their money back (no big deal) but here is the issue, they began to withhold large sums of money from my checks about 3 weeks to a month after the overpayment for a period of around 5 weeks without notifying me or obtaining written consent from me to do so. I think this is a violation of the Texas Payday Act if I'm not mistaken because they have one pay period to start withdrawing money before they have to obtain written consent and a plan to recoup the money. I get this sneaking suspicion that something isn't quite right but I'm not sure how to pursue it. Should I pursue legal action? Was what they did with the overpayment on my check a violation of the Texas Payday Act? Is somebody skimming off the top? WHAT DO I DO?? I feel so lost in this situation and need some help! Whatever advice you all give is MORE than helpful. Thanks!
