Hello all,
So a neighbor was being evicted from my building (the unit directly above me on the third level). The crew that was hired to come in and clear out the unit decided to throw debris (furniture and garbage) from the third floor window down to the ground level driveway area. My car was damaged in the process and now has a nasty dent in the hood. I spoke to the landlord and they are claiming that the area I was parked in was a "no parking" zone but there is no signage stating such and it is not in the lease anywhere stating that the driveway is not to be used for parking anytime. Now the company that she hired to do the cleanup is denying any liability and trying to get out of it. I would like to know what my options are. At the time of writing this I have filed a 1st party claim with my insurance company and from what I have read when they find them liable my insurance company should subrogate the damages and deductible from the business and name the landlord in any suit if required. I do however have a couple of worries over this, if it does indeed go that far and the landlord chooses to raise rent and/or terminate lease as we are on month to month ( I refuse to sign another year long lease with this company)
