A good idea to contact the prosecutor before my hearing?
Post Body

So I’m in Indiana and I have an initial hearing for an incident that occurred May 1st. I allegedly overdosed and was found unresponsive after pulling over to get some water at a rest stop. The officer that responded asked to secure my car and when I asked him what exactly he was going to do he said he was going to roll up my windows and lock my car. I told him as long as that was the only two things he was going to do that it was okay. He then proceeded to search my car without probable cause a warrant or consent. When he found an illegal substance in my car he came to the hospital to ask if he could ask me some questions about what he found. I told him I didn’t want to answer any further questions without a lawyer, he got visibly upset and said “that’s fine, I guess you’ll just have to deal with warrants” this was after he repeatedly told me I wasn’t under arrest and wasn’t being charged. Cut to Friday the 13th this July and as I’m waiting to get a security badge made up for the Indy airport for a job the police show up and inform me I have warrants and to put my hands behind my back. I was never read my rights but just spent the weekend in jail. I know all the evidence he got from my car is inadmissible in court since he searched my car illegally but he still put warrants on me anyways. I just want this behind me and not to have this felony on my record. I was never notified of the warrants because if I was I would’ve taken care of them promptly. He asked several times if the address on my license was accurate (it isn’t) and I watched him write down the correct address twice and the hospital I went to that night sent me a letter a few days after so I know they had the correct address on file. What would be my best course of action considering I have no money to pay for a lawyer and I just want this ordeal to end? Would calling the prosecutor to request a deferral be a good idea or should I just wait to find out what they plan to do once I get to court this Thursday? I’d like to know what they’re planning on doing if I plead guilty. Like will they leave the charges as is or will they reduce them since I’m not wanting to draw this out and it’s literally my first ever ANYTHING on my record (never had so much as a speeding or seatbelt ticket). Advice from some real legal professionals would be very much appreciated. Thanks guys.
