Father trying to take child after little to no contact in past 2+ years.
Post Body

Hi /r/legaladvice I am the stepfather of this child. My wife (child's mother) and his father were divorced in Texas. We (Child, Myself, Wife) live in New Mexico, and have so for the past 2 years. Biological father lives in Kentucky, and we have received no update of his address for 3 years.

My stepson's biological father is stating that he will be coming to NM to retrieve his son in June. He has not contacted his son in over 2 years, except for his birthday and Christmas. He also has not paid a dime of child support for almost 3 years. My wife and I are concerned that if his father does take his son, that we will never see our son again.

My question to you all; Is it OK for my wife and I to deny visitation to his father if we feel that we will not see our son after the prescribed visitation?
