Ok, so my fiance and I just had our baby yesterday, (her third child, my first biological child.) And I was told we couldn't submit our Acknowledgement of Paternity paperwork because she's still in the process of divorce. I did a bit of research on the AOP laws here in Arkansas, and found that if her legal husband would also sign the AOP denying paternity; we can submit it and I will be on my child's birthday certificate. She has been separated from him for a year and a half (her paperwork from filing for divorce states that she had legal separation included, however her case file online states that they aren't separated because a judge didn't sign off on it apparently) and we know the child is mine. However; her soon to be ex husband isn't the co-operative type. He is confirmed on hardcore drugs, he doesn't even come to see his kids (they call me daddy and as far as I'm concerned, they will always be more mine than his) and would love nothing more than to hurt us severely. This would be how... If we cannot convince him to deny paternity, what can I do? I have 10 days from the date of her birth to fix this, we can't even find where he is... Is there any way a DNA test would bypass these circumstances? I'm begging you redditors, I cannot and will not let my baby fall into a custody battle with this person.
