I saw a similar post in this subreddit that didn't include an update from OP and decided to repost my particular situation:
-In December 2017, I was fired with out cause by my supervisor who simply said that I was not a good fit at my call center position.
-In January 2018, I applied for unemployment benefits and signed up for uber and lyft thinking that I would not be receiving benefits (I am a new permanent resident and was not sure what to expect at the time".
-In February, I received my benefits and shortly decided to stop driving for Lyft and Uber. At this point, I had driven for both companies in two different dates and reported the pay in two benefit requests pay cycles. I kept requesting payments from TWC, and stopped reporting income from Lyft and Uber. I decided to stop driving for Lyft and Uber because the pay is definitely not sufficient enough to offset the miles that I put in the car with in just 2 days of driving that I did.
-After submitting my benefits payment request stating that I had stopped working hours with Lyft and Uber. My payments were automatically frozen by the system and I was required to call the customer service line to explain my request changes. After doing so, I was told that they would add the information to my case and that I could continue requesting benefits.
-At the end of February I received a "Determination of Payment of Benefits Continuation" letter stating the following:
Issue: Overpayment-Nonmonetary Determination Decision: You have been overpaid unemployment benefits. We cannot pay you benefits until you repay this overpayment. Reason For Decision: We obtained new information and after investigation found you are not eligible for the benefits we already paid you. For an explanation of why we cannot pay you, please refer to the DETERMINATION ON PAYMENT OF UNEMPLOYMENT BENEFITS we mailed you. Amount of the overpayment established by this decision: 1716.00
-In the same day I also received the following "DETERMINATION ON PAYMENT OF UNEMPLOYMENT BENEFITS" letter:
Issue: Separation from work Decision: We cannot pay you benefits. Reason for Decision: Our investigation found you quit your last work because you were dissatisfied with your pay. You were receiving the pay you had agreed to accept. Your reason for quitting is not considered good cause connected with the work. Beginning Date of No Payment Period (Disqualification): 01-07-18 What you can do: You can request that we end this disqualification if you return to employment as defined in the Texas Unemployment Compensation Act after the beginning date above and: (a) Work at least 30 hours a week for six weeks, or earn wages equal to six times your weekly benefit amount; AND (b) provide TWC with proof of your work or earnings and request that we end the disqualification. You can fulfill the work or earnings requirements while you continue to work part time.
I filed for an appeal with the TWC, and the hearing date is 3/15/2018. I am unsure what I type of case I would make to them since I did signed up after I was fired from my last job. And technically stopped working with them after realizing that I would be receiving benefits. I at this time can not repay them my benefits and are at no position to find adequate employment just yet.
Any type of advice would be greatly appreciated!
