I live in Austin, TX, off of a very busy street downtown called 6th Street (some of you may know this street because of it's partying). It was about 10:30 AM on a clear day. I was borrowing a friend's car to move my stuff and was struck in the side by another car. There is some damage to the back right passenger car door of the truck (Toyota Tacoma). There is moderate damage to the front left panel of the other driver.
Scenario: I was driving straight through a green light in the far left lane of a 4 lane street at an intersection. This lane was not a left turn only lane. As I am passing the green light, someone in the second to left lane (not a turning lane), tried to make a quick maneuver to make a left at the intersection. This caused her to hit me directly in the right side of the truck and I spun out in the middle of the street.
Luckily everyone was okay and there was some damage to the right side of my friend's truck and more damage done to the other driver's left front panel. The lady was about 75 years old and from rural Texas. She told me she was very sorry and that she was making a sharp turn because she was looking for a hotel to stay at for her grand daughter's Quinceanera. She told her family that she didn't want to drive because she was nervous and didn't know where she was going.
Concerns: 1. Who is 'at-fault' in this situation? 2. Will a friend driving the car affect my friend's insurance or make him liable to be 'at fault'? 3. Will he have to pay a deductible to get his car fixed?
