Just looking for some advice, or to be told there is nothing I can do.
Basically I am on an 80 Hour Contract. Last month I worked 161 hours, giving me 81 hours overtime.
My employer has decided that this month they are only playing me 40 hours of this overtime. The other 41 hours has be turned into Time Off In Lieu (TOIL)
There was no real warning, except my line manager telling me the day before that they were doing it, which my response was no.
Can they legally do this? My contract states this:
You will only be paid for any hours you work beyond your contractual hours if you have the prior approval of your line manager. To be paid in the month in which the overtime is incurred, the claim must be submitted before the salary cut off date for the payment of your monthly salary. Overtime is normally paid at your hourly rate, save for work on a public holiday, which will be paid at double time or normal time plus time off in lieu, at the discretion of the Director Of Operations.
So will I be able to claim the rest of my overtime? Or should I just kiss that one goodbye?
