I just found out that my landlord is possibly going to jail/prison and I am looking to know what my rights are or things I should do to protect myself and roommates. History: Myself and two roommates are currently on a month to month lease with our landlord being a single gentleman. I have been in the house two years now but my roommates are a few months over a year. No complaints to the landlord. This is his only rental property. He did just get the house appraised. He stated for taxes purposes.
Story: I just found out that he is currently in the process of fighting his 5th OWI. It is set to have the pretrial hearing next week. I did not find out this from him so I have not spoke with him about it. The issue is his kids were also in the car when he got pulled over so that is additional charges. He has never served more than a few days and house arrest for his past offenses due to good lawyers. I am wondering now if the appraisal was for possible selling due to the impending fines and possible jail time that could come from this.
Back to my question: I know he can hand the property management over to someone for while he is in which would make sense so he can pay the mortgage on this place plus his house. But is it smart to push for a lease to protect my roommates from whoever takes over management? Can we get kicked out if he doesn't pay mortgage while in? I am assuming if he intends to keep it he will relay who we are to pay rent to, but what if he doesnt? Who do.we reach out to then?
