Hi there, posting on behalf of a friend who does not have Reddit. All names in this post are fake. We are in Arizona, USA.
Mel lives in a house owned by their elderly parent, Dee. Dee does not reside in the home and lives over an hour and a half away. Mel is not a legal owner but has been listed on utility bills and a previous homeowners' insurance policy that is no longer in place. There is no rental agreement establishing Mel as an occupant. Also, there is a pending guardianship hearing for Dee.
Mel believes a cousin, Kevin, has falsely obtained power of attorney over Dee and is acting on Dee's behalf to try to sell the home Mel occupies. Dee did not have the capacity to sign for such a transaction at the time.
Mel reported Kevin to adult protective services and to the attorney general because Mel was told that Kevin falsely claimed or obtained power of attorney for Dee.
Is there anything Mel can do to stop the sale of the home?
