Long story short. My step daughter, then 15, snuck and drank some of my vodka. We (her dad and I) have been charged (misdemeanor) with contributing alcohol and tobacco to a minor. For reference, we didn’t even know she had a vape with her.
This happened almost 3 years ago. We found out that we both had warrants issued for our arrest by a kind officer who stopped by our home to tell us as a courtesy. He knew we had other children as someone (ehh hem, ex-wife) was calling the sheriff’s office multiple times a day demanding we be arrested in front of our children. He said there’s not a warrant officer in our county and he wasn’t there to arrest us but wanted us to be aware of the warrant as he’d hate for us to get pulled over knowing we had young children. Upon going to take care of this I was arrested, spent a day in jail, arraigned (plead innocent)and now waiting pre-trial.
During all of this I’ve had several officers, including attorneys in disbelief that charges were even brought forth as everyone thought it was a civil infraction not a misdemeanor. In Michigan it is a misdemeanor but I cannot find out any case law or anything regarding the penalty. Only for selling. I’ve also read something about giving your kid a drink in your home, your call? Any help in this matter would be appreciated. TIA
