I'm not one to ask for help but my mom has a situation with her house in Florida. I'm sorry in advance if this is convoluted.
In June or July 2023 she signed a contract with a roofing company to replace our roof. This was done through the homeowners insurance after storm damage occurred. She was told by the insurance company she was responsible only for a $100 deductible which she paid.
The contract with the roofer has a clause that basically says of the complete payment isn't made the homeowner is responsible. The insurance company did not pay $5800. We don't know why other than they said they needed more information from the roofer.
In January 2024 the roofing company placed a mechanics lien on the house. They are good for one year. The roofing company told her not to worry, it was a formality and that βthe insurance company will pay it, this happens all the time.β
Fast forward to Saturday she gets a registered letter from the roofer's attorney saying she has five days to contact him to make payment arrangements. She doesn't have that money. She's handicapped living on SSI and what little money I give her. My brother only works sporadically for friends doing house cleanings as he is her 24/7 caretaker for nearly 5 years. They are both on EBT as well.
I've advised her to contact the insurance company and that attorney on Monday and also consult with an attorney on how to proceed. I'm at a loss. She's going on crying jags.
I need advice, maybe an attorney who does this stuff in Florida near the Villages. Anything will help. She'd never do a gofund me.
