11 days ago I was rear ended in stop and go traffic. It wasnāt an accident that totaled my car or anything, but it was strong enough that I got whiplash. We both pulled over, and the driver was an older man (70-80s) and his granddaughter (20s) was in the passenger seat. He seemed confused and the only thing he said to me was introducing himself. His granddaughter did most (if not all) of the talking. She apologized several times and he was clearly at fault. I got a picture of his insurance and her phone number and told her I would get my car looked at and text her if there were any damages. Neither of us brought up calling the police. My thought was that it was such a minor accident that I didnāt need to.
I got an estimate for the damage on Monday. I went to a body repair shop that is a national chain, and got an estimate of 1.7k. We texted back and forth about it, and she was not happy with the price. She did admit fault, I believe, by not denying that her grandfather was indeed the one who caused the damages. I gave her the phone number for where I got the estimate since I canāt speak to why it was so much money.
Today I got a call from the mechanic asking what I wanted to do, and I called back to see if they had talked to her. She did call them and argued about the price (I took a sound recording of the conversation with the shop about the phone call they had with her). The last thing I said to her was that I needed to know by Monday if she wanted to go through insurance or out of pocket. And even explained to her that her insurance could have an independent adjuster come out and see my car to make sure itās not over priced. The last thing she said to me was that she is going to give my number to her grandfather to go over āall of that with meā. This was at 3:50pm today and I havenāt heard anything.
Iām wondering if I should file a police report now. I know I probably should have at the time of the accident, I just really didnāt think it was necessary.
