I built up a brand and have been selling a product for months now, it went successful and now I have copy cats everywhere. They copied my package in a similar manner but its different enough that I can't report it for copyright, but they use my brand name on the packaging and in the title of the product. Its obvious that they are using the likeness of my product to generate sales.
I registered a trademark over 3 months ago and its pending and can take another year and a half to get approved.
The site where they are selling it on has no option like amazon where you can register a pending trademark.
The people selling it are based in China.
Is there any option at all to enforce a pending trademark when ive been selling the product for months and have records of thousands of sales on it?
