I live in FL, so does my mom and older sister. My sister lives with my mom, cant keep a job, and is mentally unstable. She is very lazy, a user, manipulator, and just an overall bad person. My mom's house is paid off and has a seperate duplex that has about 100k of mortgage left. I've always acted as her property manager, laying tile, maintenance, dealing with tennents, yard work etc. My sister never did anything there. I enjoy working hard and working there. I have children, more like babies and she does not and won't ever (shes a lesbian), so I need all the income I can get. I would love to inherit the duplex and my sister the house. I get extra income to support my family, she gets free housing minus taxes and insurance so she can bum around all day if she wants and generally keep it together on minimum wage, it's a win win. However, she doesn't really see it that way. She thinks we're going to split everything 5050. Which I don't even know how that would work. Like I do all the work at the duplex but you take 50%!? Nah. My mom refuses to have a will drawn up or even talk about it, idk she has a weird fear of death, if she talks about it it will happen. Anyways, i fear my mom is putting me in a really bad spot here and i need to know what are my options here if she passes (i dont want that to happen i love her very much). If my sister doesn't see things the way I do, where do we go from here. Can I take her to court to win the duplex and give her the house? How does probate and mortgage transfer happen in this scenario? I have legal insurance and financial resources, something she does not. Just planning for the worst case scenario because she's a terrible person and unpredictable so it's hard to gauge what she's going to do. Please help, I just want to provide for and protect my children. Thanks in advance! Yall are doing the lords work :)
