I am a medical provider who lives and practices in rural NY. My employer has multiple offices in NY and VT.
I am leaving my job to work for a competitor that is in violation of my non-compete agreement. The agreement states that I can not work in any similar capacity to my current job, within 25 miles of any office location (being a rural area, this would put me out of a job), for 1 year after employment. There is also a non-solicitation and anti-raiding policy, saying I cannot work with any current or potential patients of the practice. It states that this will be enforced in VT, even though I don't work there and am not licensed there.
I've spoken to a local NY lawyer who told me the agreement will be laughed out of court. He was unsure of the enforceability between NY/VT, since NY has strict regulations on noncompetes and VT does not.
I'm just looking for some reassurance. Is this at all enforceable in VT?
